Terms of Service

Pathstone is an online board game operated by Pathstone, a series of Lemonberry Labs LLC, a Delaware series limited liability company (“we,” “us,” or “our”). By using Pathstone, you agree to these terms. If you do not agree, do not use the service.
Who can play
You must be at least 13 and legally able to agree to these terms. If you are under the age of majority where you live, you need a parent or guardian’s permission, and they must agree to these terms on your behalf.
Your account and conduct
Provide accurate account information, protect your sign-in access, and contact us if you suspect unauthorized use. Do not harass others, impersonate anyone, use unlawful or infringing content, cheat, interfere with the service, or attempt unauthorized access. We may suspend or close accounts for violations or security risks.
The service and your content
We grant you a limited, personal, nonexclusive, revocable right to use Pathstone for its intended purpose. We and our licensors retain rights to the service, branding, and software. You retain rights to content you provide and grant us permission to host, display, and use it as needed to operate the service. Your display name, avatar, and game activity may be visible to other players.
Pathstone is currently free. Features, availability, and game records may change or be discontinued. We do not promise uninterrupted access or permanent storage of games. Our Privacy Policy explains how we handle information.
No warranties; limited liability
To the fullest extent permitted by law, Pathstone is provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not guarantee that the service will be secure, error-free, or uninterrupted.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill arising from use of or inability to use Pathstone. Our total liability for claims relating to the service or these terms will not exceed the greater of US $50 or the amount you paid us for the service in the preceding 12 months. These limits apply regardless of the legal theory and do not exclude liability or consumer rights that cannot lawfully be excluded.
Series LLC structure
Your agreement is with the Pathstone series of Lemonberry Labs LLC. Subject to the requirements and limitations of Delaware law, including 6 Del. C. § 18-215, obligations of the Pathstone series are enforceable only against its assets, not those of Lemonberry Labs LLC generally or another series. Obligations of the company generally or other series are not enforceable against Pathstone’s assets. Nothing here creates a guarantee by another series or limits rights that applicable law does not allow us to limit.
Law and changes
Delaware law governs these terms, except where mandatory local law applies. Disputes may be brought in the state or federal courts in Delaware, subject to any mandatory rights to bring a claim elsewhere. If a provision is unenforceable, the remaining terms continue to apply.
We may update these terms by posting a revised version and date here. For material changes, we will provide a prominent notice in the service or by email before they take effect. Continued use after the effective date means you accept the updated terms.
